Welcome to Bloczy. These Terms of Service ("Terms") govern your use of our platform, including our website, mobile apps, and services (collectively, the "Platform"). Please read them carefully.

⚠️ Important Notice: These Terms include a binding arbitration clause and class action waiver, affecting how disputes are resolved. By using our Platform, you agree to these Terms.
 

• Company: Bloczy ("we", "us", "our")
   
• Platform: Our website(s), mobile applications, APIs, and any associated services.
   
• User: Anyone who accesses or uses our Platform ("you").
   
• Content: All text, graphics, images, video, audio, and other materials posted or shared through the Platform.
   

By using the Platform, you accept and agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity.

We may update these Terms at any time. If we do, we’ll notify you by updating the "Last Updated" date and posting the new Terms. Continued use of the Platform after changes means you accept the revised Terms.

You must be at least 18 years old or the age of majority in your jurisdiction to use our Platform.

You agree to use the Platform lawfully and ethically. You may not:

• Violate any law or regulation.
   
• Infringe on our or others’ intellectual property rights.
   
• Interfere with the security or performance of our Platform.
   
• Post or share harmful, misleading, or offensive content.
   
• Attempt to gain unauthorized access to our systems.
   

We may access, preserve, and disclose any of your information if we are required to do so by law or in good faith believe it is reasonably necessary to comply with legal process or protect the rights, property, or safety of Bloczy, its users, or the public.

Our collection and use of your personal data are governed by our Privacy Policy.

All intellectual property on the Platform belongs to Bloczy or our licensors. You may not copy, distribute, modify, or use our content without written permission.

• App License: We grant you a limited, non-exclusive license to download and use our app for personal, non-commercial use.
   
• Content License: We grant a limited right to view and interact with our content, but you may not redistribute or create derivative works without permission.
   

We are not responsible for third-party content or websites linked from our Platform.

Any feedback you provide becomes our property, and we may use it without restriction.

We respect copyright law and expect users to do the same. Unauthorized reproduction, modification, distribution, or display of copyrighted content is prohibited.

Our Platform and all services and content are provided "as is" and "as available." We make no warranties or representations regarding the reliability, quality, or availability of our services. Use is at your own risk.

Bloczy is not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform or any third-party services accessed through it. You acknowledge and accept all risks related to transportation, mobile data, and third-party integrations used via Bloczy.

The Platform may experience limitations or delays due to the nature of internet and electronic communications. Bloczy is not responsible for such disruptions.

You agree to indemnify and hold harmless Bloczy, its affiliates, and employees from any claims or damages resulting from your misuse of the Platform or violation of these Terms, including but not limited to third-party claims, governmental investigations, or regulatory penalties.

You agree to comply with all applicable export and trade regulations. You may not use the Platform in violation of these laws.

These Terms constitute the full agreement between you and Bloczy concerning the use of our Platform. They supersede all prior agreements or understandings.

You may not assign these Terms without our consent. Bloczy may assign these Terms freely.

These Terms are governed by the laws of the State of California and applicable U.S. federal laws, without regard to conflict-of-law principles.

All disputes must be resolved through binding arbitration under the rules of the American Arbitration Association. You waive the right to a jury trial and class action lawsuits. Arbitration will take place in Los Angeles County, California unless otherwise agreed.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. No waiver of any term will be deemed a further or continuing waiver of such term.

These Terms do not grant any rights or benefits to any third party.

Bloczy facilitates the connection between drivers and passengers. Bloczy is not responsible for actions or omissions of individual drivers, vehicle conditions, or service reliability. Bloczy does not guarantee safety, arrival times, or outcomes. Any insurance or service guarantees offered are subject to additional terms.

You acknowledge that use of mobile services includes inherent risks, such as unauthorized access to personal data, GPS location, and payment methods. Bloczy is not responsible for any data breach or device-level exposure resulting from user negligence or third-party vulnerabilities.

We may suspend or terminate access to our Platform without notice for any conduct that we believe violates these Terms, applicable laws, or harms our users, partners, or reputation. Upon termination, your right to use the Platform will cease immediately, but provisions concerning IP rights, liability, and dispute resolution will survive.

Bloczy may require or provide insurance coverage for services performed. You agree to comply with applicable transportation and health regulations, including but not limited to ADA and HIPAA where relevant. We may report unlawful conduct to the authorities.

Bloczy is committed to making services accessible to all users, including individuals with disabilities. We prohibit discrimination on the basis of race, religion, nationality, gender, sexual orientation, disability, or age.

Bloczy is not liable for failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government orders, or infrastructure failure.
